Gerber Collision & Glass, based in Elmhurst, IL, is abandoning its plan to convert an old CVS Pharmacy in Darien, IL, into an auto body shop.
In November, a divided Darien City Council approved the shop, despite opposition from neighbors who later sued the city.
In a letter to the city Feb. 1, the company said it was confirming it would not develop the site southeast of Lemont Road and 83rd Street.
In an email Feb. 5, City Administrator Bryon Vana told Patch the city attorney and other lawyers will meet to discuss the litigation and the special use permit the city approved for the site.
In January, the city's attorney, John Murphey, asked a DuPage County judge to throw out the lawsuit, saying the neighbors failed to detail how the auto body shop would hurt them.
The neighbors' attorney, Elizabeth Uribe of Downers Grove, could not be reached for immediate comment.
